How to Successfully Handle and Win at Depositions, Motions, and Trial

Course Description:

A thorough, evidence-based, impartial investigation followed up by outstanding report-writing by all members of the investigative team that results in an arrest is a good start.  However, that is only a portion of our job as law enforcement officers and as prosecutors.  There are many examples throughout history of what appeared to be “strong cases” completely collapsing as a result of witnesses faltering on the witness stand.  A skilled defense attorney knows how to stay away from the facts of the case and focus on what law enforcement “did wrong” during the course of the investigation or even concentrate on the things that they “did not do at all.”      Without the proper preparation and training, a strong case can fall apart very quickly where it really counts, and that is in front of the jury.  The last thing that we want to do as law enforcement officers is victimize a family a second time because we were not prepared or properly trained to walk into a courtroom and survive the stressful experience of an intense cross-examination.  Do not let this happen to you, your case, your victim, or your community.


The Lead Instructor for this informative 8-hour class is the Chief of the Homicide Trial Unit for the Broward County State Attorney’s Office, Stephen Zaccor.  The course is designed to benefit any witness who testifies for the prosecution from the first responding officer to the Crime Scene Investigators, Lead Detectives, Lab Personnel, and Medical Examiners.  The students who attend this class will be provided with valuable information, techniques, and strategies on the art of testifying.  Therefore, we encourage attendance from ALL law enforcement officers and any other personnel who participate in the investigation, discovery, or trial process.  Whether you work for a municipal police department, a county sheriff’s department, a state law enforcement agency or a federal law enforcement agency, this class will be extremely beneficial to you because it will sharpen your testifying skills and you will have much more confidence the next time that you walk into a courtroom.

Course Objectives:

At the conclusion of this 1-day training course, participants will have an increased amount of confidence, knowledge, and advice on how to properly prepare and perform during depositions, pre-trial hearings, and testifying in front of a jury while being cross-examined by a seasoned defense attorney.

Who Should Attend:

All City, County, State and Federal Law Enforcement Officers to include Road Patrol Officers, Detectives, Crime Scene Technicians, Supervisors, Command Staff Personnel, Investigators working for a State/District Attorney’s Office, Medical Examiners/Coroners, Investigators from a Medical Examiner/Coroner’s Office, Investigators and Judge Advocate Generals from the U.S. Armed Forces, Police Legal Advisors, and Crime Analysts.

Requirements to Attend:

To attend this class, you must be currently employed as one of the below-listed descriptions:

1. A sworn law enforcement officer

2. A sworn reserve law enforcement officer

3. A civilian assigned to a crime scene unit or traffic unit at a L.E. Agency

4. A prosecutor working for a State Attorney/District Attorney’s Office

5. An Investigator working for a State Attorney’s Office

6. A Doctor working at a Medical Examiner/Coroner’s Office

7. An Investigator at a Medical Examiner/Coroner’s Office

8. Active Duty or Reserve Military Personnel who are responsible for investigating or supervising or prosecuting criminal cases.  This would include Investigators from the U.S. Armed Forces, Judge Advocate Generals (JAG’s), etc.

9. Police Legal Advisors

10. Crime Analyst

Fees:

$195 per student – Law Enforcement Agencies who host one of our training classes will automatically receive two free admissions to attend any of our training classes.

Dress:

Students attending our training classes should follow their department or agency Policies and Procedures Manual guidelines regarding authorized clothing and uniforms to wear while attending approved training classes.  If law enforcement personnel choose to wear civilian clothing to our training classes and they plan on being armed, we would respectfully request that you either keep your firearm concealed or if your firearm is exposed, please have your agency ID and/or a badge clearly visible at all times identifying you as law enforcement officer.
